Terms of Use

1. Your Agreement
DataPro Private Limited ('DataPro', 'we', 'us', 'our') is a company incorporated in the Republic of Singapore. This document represents a legal document that sets out the basis and terms upon which DataPro provides use of the mobile wi-fi device and data services operated by DataPro under the “Hotspot” brand (or such other brand name) that is offered to incoming travelers to Singapore via Changi Airport (“Hotspot Services”) and/or such other product and services provided by DataPro, our partners and affiliates and our third party services providers (”Other Services”). Please read these terms of use (“Terms of Use”) carefully before proceeding with the DataPro website (“Website”), mobile phone application (“App”) or Self-Service Ticket Kiosk (“Kiosk”) and/or use the Hotspot Services and/or Other Services.

This Terms of Use, along with our Privacy Policy at https://www.hotspot.travel/privacy-policy and other guidelines highlighted to you (collectively “Legal Terms”), constitute the entire and only agreement between you and DataPro, and supersedes all other agreements, representations, warranties and understandings with respect to the Website, App, Kiosk, the Hotspot Services, Other Services and the other matters contained herein.

By using the Website, App or the Kiosk or the Hotspot Services or Other Services, you agree to fully comply with and be bound by our Legal Terms. Please review them carefully. If you do not accept our Legal Terms, do not access and use the Website, App or Kiosk (as the case may be). If you have already accessed the Website, App or Kiosk (as the case may be) and do not accept our Legal Terms, you should immediately discontinue use of the Website, App and Kiosk (as the case may be).


2. Definitions
Capitalized terms, unless otherwise defined, have the meaning specified below:-

"Affiliate" means any related or associate company of DataPro including their successors, assigns, employees and agents.

"Charges" means all activation, connection, subscription, usage, and administrative charges and other fees to be paid by you for or relating to the Hotspot Services or Other Services. The Charges will be in accordance with the rates as contained in the Website, App and the Kiosk.

“Hotspot Device” means the SIM card, mobile wi-fi device and/or equipment which we provide to enable you to access the Hotspot Services and Other Services.

"IMDA" means the Info-communications Media Development Authority of Singapore, its successors and assigns.

"Network" means all networks owned, maintained or operated by, and/or leased or licensed to a telecommunication service provider through which we provide the Hotspot Service and Other Services.

"Regulatory Authority" means IMDA, its successors and/or assigns.

"SIM" means the Subscriber Identification Module.

"Taxes" means any and all taxes, goods and services tax, duties, levies and other similar charges imposed under any laws of the Republic of Singapore in respect of the provision of the Hotspot Service and Other Services or on any Charges or payment due from or payable by you to us.

"Unauthorised Acts" means any tampering, modification, removal, destruction and/or damage of or to the Network, unauthorised connection to the Network, including without limitation, such connections that cause interruption, disruption, congestion in and to the Network or any third party's networks or systems, or use of the Network for a purpose other than that of the reception of the Hotspot Service and Other Services according to the Legal Terms.

“Website” means the website www.hotspot.travel or any other website set up by us to enable you to register and access the Hotspot Services and Other Services.

"you" or "your" when used in this Terms of Use includes (1) any person who accesses the Website/Kiosk and (2) persons for whom you make a registration and/or purchase of the Hotspot Services and/or Other Services (including his or his successors and permitted assigns) and anyone appearing to us to be acting with that person's authority or permission.

3. The Hotspot Service and the Other Services
3.1 Subject to this Terms of Use, DataPro may either offer to provide the Hotspot Services and Other Services by itself or on behalf of our partners and affiliates and third party services providers as described on the Website, App and the Kiosk. The Hotspot Services and Other Services that have been selected by you on the Website or Kiosk are solely for your own use, and not for the use or benefit of any third party.

3.2 DataPro may change, suspend or discontinue the Hotspot Services or any of the Other Services at any time, including the availability of any feature or content. DataPro may also impose limits or conditions on the Hotspot Services and Other Services or restrict your access to any part or all of the Hotspot Services or Other Services (as the case may be) without notice or liability.

3.3 DataPro reserves the right to change any and all the features of the Hotspot Service or Other Services, at any time without notice.

3.4 DataPro does not guarantee that the Hotspot Services or Other Services will always be available or uninterrupted. DataPro will not be liable to you if for any reason the Hotspot Services or Other Services are unavailable at any time or for any period.

3.5 You can subscribe for the Hotspot Services or Other Services if you are at least 18 years old with a valid passport and valid boarding pass with Singapore Airlines or any other airlines as listed on the Website, App and Kiosk to enter the Republic of Singapore. We may refuse to provide the Hotspot Services and any Other Services at our discretion.

3.6 You are responsible for making all arrangements necessary for you to have access to the Hotspot Services or Other Services. You are also responsible for ensuring that all persons who access the Hotspot Services or Other Services registered in your name are aware of this Terms of Use and other applicable terms and conditions for the Hotspot Services or Other Services, and that they comply with them.

4. Registration, Activation and Security
4.1 You are to register to access the Hotspot Services and Other Services and to select a data plan from DataPro for the Hotspot Services and Other Services via one of the Kiosk located within Changi Airport or other designated locations. You will need to follow the registration process as reflected in the Kiosk. That will include the scanning of your passport as required by the Local Regulatory Authority.

4.2 Upon completion of the registration process you will proceed to collect your Hotspot Device from our representative located within Changi Airport or other designated locations and present your receipt as proof of booking and/or such information or document as may be required by our representative, including your passport. If you fail to collect the Hotspot Device within the booking period for any paid data plan, no refunds will be granted.

4.3 You may reserve the Hotspot Device prior to your flight on the Website by providing your Booking Reference Number. You may then proceed to register at the Kiosk and pick up your Hotspot Device upon arrival at Changi Airport.

4.4 During the registration process you shall provide accurate, complete and updated registration information. Failure to do so shall constitute a breach of this Terms of Use, which may result in immediate termination of your access to the Hotspot Services and Other Services.

By registering, you are certifying that you are the actual owner of the passport submitted to us.

4.5 DataPro reserves the right to refuse registration or access to the Hotspot Services and Other Services at its sole discretion.

4.6 After picking up the Hotspot Device you are required to download the Hotspot App to activate your WiFi connection.

4.7 You may also use the App and Kiosk to purchase any data plans under the Hotspot Service or to register for any of Other Services.

5. Passports, Visas & Insurance
5.1 It is your responsibility, regardless of nationality and destination, to check with the relevant authorities of your home country for current rules on disclosure of passport details to third parties.

6. Paying for the Hotspot Service and the Other Services
6.1 All purchases made on the App and Kiosk are final and non-refundable. In the event of a cancelation or request for modification of the Hotspot Service and Other Services purchased, DataPro is not obliged to honor such requests and the entire amount paid by you may be forfeited.

6.2 Refunds, if any, are provided at the sole discretion of DataPro.

6.3 Once you are registered and subscribed for any part of the chargeable Hotspot Services or Other Services, you must pay for the said chargeable Hotspot Services or Other Services upon registration or extension thereto, even if they are used by someone else (whether with or without your consent or your knowledge).

6.4 If you use any services provided by third parties where we are billing on their behalf, you are liable to make payment as required by the particular third party service provider.

6.5 We will only charge you for the chargeable plans under the Hotspot Services and Other Services you registered and subscribed for.

6.6 You may pay through your credit/debit card or in some other payment system or method we may agree to. However, you are responsible to ensure that you have available balance or credit in your account to honour the payment.

6.7 No cash payment is allowed for the Hotspot Service or the Other Services and our representatives are not authorised to receive any money from customers for the Hotspot Services or any of the Other Services.

6.8 Unless we state otherwise, all Charges are payable in Singapore Dollars.

6.9 Unless there has been fraud or manifest error on our part each receipt issued by us is conclusive evidence against you of the accuracy and completeness stated in it.

6.10 You are responsible for all Taxes (including GST).

7. Additional or Modification of Charges 
7.1 DataPro reserves the right to require payment of fees or charges for the Hotspot Service and Other Services. You shall pay all applicable fees or charges, as described on the Website, App or Kiosk in connection with such services selected by you.

7.2 DataPro reserves the right to change its price list for fees or charges at any time, upon notice to you on the Website, App and the Kiosk. Your use, or continued use, of the Hotspot and Other Services following such notification constitutes your acceptance of any new or revised fees or charges.

8. Deposit
8.1 You will be required to place a deposit with us as security for your performance of your obligations to us, including the return of the Hotspot Devices. We may also require the amount of the deposit to be increased, before we provide or continue to provide the Hotspot Service or any of the Other Services to you. This deposit is separate from your payment of the Charges and you may not require us to offset it against your outstanding Charges. However, we may apply some or all the deposit to offset any outstanding amounts you owe us.

8.2 If there is any amount of your deposit remaining when your access to the Hotspot Service or Other Services expires or is terminated and all other amounts payable by you have been paid, we will refund the balance to you without Interest.

9. Conclusiveness of Records
9.1 In the absence of fraud or manifest error, all our records relating to the Hotspot Service and Other Services are conclusive evidence of their accuracy and completeness.

10. Terms of the Hotspot Devices
10.1 DataPro grants you a non-exclusive, non-transferable, revocable license to access and use our Hotspot Devices for access to the Hotspot Service and the Other Services strictly in accordance with the Terms of Use.

10.2 You shall ensure the safety of the Hotspot Device while it is still registered in your name.

10.3 You shall be liable to DataPro for any loss or damage to the Hotspot Device.

11. Change of Terms of Use
11.1 Any decision to be made by us or actions that we may take in relation to the Hotspot Service and Other Services may be made at our sole discretion

11.2 We may amend our Legal Terms at any time without specific notice to you. The latest copies of our Legal Terms will be posted on the Website, App and the Kiosk, and you should review all Legal Terms prior to using the Website, App or the Kiosk to register for access to the Hotspot Service and the Other Services. After any revisions to our Legal Terms are posted, you agree to be bound to any such changes to them. Therefore, it is important for you to periodically review our Legal Terms to make sure you still agree to them.

11.3 Your continued use of the Website, App or Kiosk (as the case may be) or the Hotspot Services and/or Other Services after any such changes or modifications constitutes your acceptance of the revised Terms of Use. If you do not agree to abide by the revised Terms of Use, do not use or access or continue to use or access the Website/App/Kiosk and/or the Hotspot Services and/or Other Services.

11.4 In addition, when using the Hotspot Services and/or the Other Services, you shall be subject to any additional terms applicable to such Hotspot Services and/or Other Services (as the case may be) as posted on the Website, App and the Kiosk. All such terms are hereby expressly incorporated by reference in this Terms of Use.

12. Users Representations, Warranties and Undertakings
12.1 You represent, warrant and undertake to DataPro that you will not use the Hotspot Services or Other Services in a manner that: (a) Infringes or violates the intellectual property rights or proprietary rights, rights of publicity or privacy, or other rights of any third party; or (b) Violates any law, statute, ordinance or regulation; or (c) Is harmful, fraudulent, deceptive, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable; or (d) Constitutes libel, impersonates any person or entity, including but not limited to any employee or representative of DataPro; or (e) Contains a virus, trojan horse, worm, time bomb, or other harmful computer code, file, or programme.

12.2 DataPro reserves the right to restrict or bar your access to the Hotspot Services or Other Services for any reason including but not limited to, receipt of claims or allegations from third parties or authorities relating to such use or if DataPro is concerned that you may have breached any of the preceding representations, warranties or undertakings, or for no reason at all.

12.3 You acknowledge and agree that you shall be solely responsible for your own use of the Hotspot Services or Other Services.

12.4 You are responsible for all of your activity in connection with using the Hotspot Services and Other Services. You further represent, warrant and undertake to DataPro that you shall not: (a) Conduct any fraudulent, abusive, or otherwise illegal activities which may be grounds for termination of your right to access or use the Hotspot Services and/or Other Services; or (b) Violate the security of any Network, any computer network, crack passwords or security encryption codes, transfer or store illegal material (including material that may be considered threatening or obscene), or engage in any kind of illegal activity that is expressly prohibited; or (c) Decompile, reverse engineer, or otherwise attempt to obtain the source code of Hotspot Device.

13. Legal Compliance
13.1 You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of the Website, the Kiosk and the Hotspot Service and Other Services.

13.2 DataPro reserves the right to investigate complaints or reported violations of our Legal Terms and to take any action we deem appropriate, including but not limited to canceling your access to the Hotspot Services and Other Services, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information, as allowed under our Privacy Policy.

14. Cancelation of Hotspot Services and/or Other Services
14.1 You may cancel your access to the Hotspot Services and/or Other Services by returning the Hotspot Device to our representative located at Changi Airport.

15. Termination by DataPro
15.1 This Terms of Use shall remain in full force and effect while you use the Hotspot Service and the Other Services. DataPro may terminate or suspend your access to the Hotspot Service or the Other Services at any time, for any reason, and without notice or liability.

15.2 DataPro may also terminate or suspend access to any and all of the Hotspot Service or the Other Services immediately, without prior notice or liability, if you breach any of the terms or conditions of this Terms of Use, including but not limited to:-

  a) you provided incorrect, false or incomplete information to us;
  b) compliance with the requirements of the relevant Regulatory Authority or any other authority;
  c) we believe that you are likely to create imminent harm (such as interruption, disruption, congestion or any Unauthorised Act) to the Network or any third party's networks or systems or our provision of the Hotspot Service or the Other Services, or to defraud us, or are likely to create imminent harm or harass or are abusive to our personnel.

15.3 In the event where it has come to DataPro’s attention that the Hotspot Device is used in a manner that violates this Terms of Use or in a manner otherwise not intended by DataPro, DataPro reserves the right to the following: (a) Termination of your access to the Hotspot Service and Other Services with immediate effect; or (b) Refusal of the provision of the Hotspot Service and the Other Services to you; or (c) Any other measures as deemed appropriate by DataPro at its sole discretion in each case without compensation to you, and without prejudice to our rights to damages for any breach by you of the Legal Terms

15.4 In the event of suspension or termination, you may immediately contact our customer service, either by live chat or email to us at support@hotspot.travel or visiting any of our counters at Changi Airport to tell us why such suspension or termination should not occur. We will consider each case and where we deem appropriate, will not proceed with the suspension or termination of such account or take any other appropriate action where necessary.

15.5 The termination or expiry of the access granted to you to access the Hotspot Service or the Other Services will not affect any accrued rights and remedies of either party against the other party. 15.6 DataPro shall not be liable for any damages, losses, costs or expenses of any nature suffered by you or third party resulting in whole or in part from the exercise of our rights under this Agreement. By using the Hotspot Service and the Other Services, you agree to waive and hold us and our partners, affiliates and third party service provider harmless from any claims relating to any action taken by us.

16. Effects of Termination
16.1 Upon termination of your access to the Hotspot and Other Services, your right to use the Hotspot Service and Other Services will cease immediately. All provisions of this Terms of Use which, by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

16.2 If your access to the Hotspot Service and Other Services expires or is terminated for any reason whatsoever, DataPro reserves the right to cancel any outstanding access to the Hotspot Service or Other Services you may have registered and/or purchased prior to said termination, without refund or liability to you.

17. Your Responsibilities
17.1 Unless we agree otherwise, you are responsible for obtaining and maintaining, at your own costs, all devices necessary for the access and use of the Hotspot Service and the Other Services

17.2 We or our partner, affiliate or third party service provider may provide, sell, lease, rent or maintain the devices to or for you under a separate agreement. This is subject to stock availability.

17.3 For the avoidance of doubt, unless we otherwise agree in writing, we are not responsible for any device not provided by, purchased, leased or rented from us, including for any loss or damage caused by the use of such device.

17.4 You are solely responsible for all content, products and services you may access, use or acquire using the Hotspot Service or the Other Services and we are not liable for any such content, products or services. You are solely responsible for all content, products or services that you transmit or make available via the Hotspot Service or the Other Services.

17.5 It is your responsibility to :-

  (a) provide accurate and complete information to us, and inform us immediately if there are any changes to the information you gave us;
  (b) pay all Charges even where there is any suspension, interruption or loss of the services provided;
  (c) comply with all applicable laws, rules and regulations, and any requirements or restrictions which we or our partners and affiliates and our third party service providers may impose on the use of the Hotspot Services or the Other Services;
  (d) comply with all instructions, notices or directions issued by us;
  (e) take all reasonable steps to prevent fraudulent, improper or illegal use of the Hotspot Services and Other Services; and
  (f) abide by all copyright notices, trademark rules, information, and restrictions contained in the Website and the Kiosk.

17.6 You shall be responsible for the use of the Hotspot Service and the Other Services you subscribe for. This would include not using or allowing the Hotspot Services and the Other Services you subscribe for to be used in any unlawful way or in a way that could give rise to civil or criminal liability, including:-

  1. posting, soliciting, transmitting or disseminating content which may be misleading, defamatory, offensive, indecent, objectionable or illegal, or which may cause annoyance, harassment or anxiety to anyone, including junk/spam mail, solicitations, or distributing mail to any party who has not given permission to be included in the distribution. Junk/spam emails do not have to be sent from your account to violate this term;
  2. forging or issuing misleading message headers to mask the originator of the message or employing any other method to disguise or mislead anyone on the source or quantity of the emails transmitted;
  3. posting, soliciting, transmitting, disseminating, advertising or storing content that is pornographic or contains malware such as computer viruses, worms, trojan horses, time bombs, cancelbots or any other harmful, damaging or destructive programmes;
  4. illegally, or without appropriate authority, accessing any part of the Hotspot Services or the Other Services or any third party equipment, accounts, systems or networks to which you can connect through the Hotspot Services or Other Services (directly or indirectly), or doing anything as a precursor to such an attempt (including port, stealth, security or penetration scans or other illegitimate information gathering activity) on the servers or network of DataPro or other service providers;
  5. disrupting or undermining the security of the Network and systems connected to the Hotspot Services or Other Services, or violating the rules and regulations of such Network. This can include failing to update software or accessing websites that are known to be vulnerable to malicious activity;
  6. violating anyone's rights, including their intellectual property and privacy rights, or anyone's uninterrupted use of any telecommunication or data networks, for any fraudulent, illegal or improper purposes;
  7. reselling or providing any part or component of the Hotspot Service or the Other Services, whether for profit or not, to third parties without our prior written consent;
  8. advertising, transmitting, facilitating or making any content, product or service available that may breach this Terms of Use; and
  9. doing anything, even if it is lawful, that we decide is harmful to our customers, operations, reputation, goodwill or customer relations.

17.7 You agree that these restrictions are reasonable and necessary for the operation, management and maintenance of the Hotspot Service and Other Services. However, if any of the restrictions are held by a court to be invalid for any reason, but would be valid or effective if any part of its wording were deleted, you agree that the restriction shall apply to you with such deletions or amendments made so that it is valid and effective at law.

18. Use of Network
18.1. You agree that we are NOT the owner of the Network at all times, even if parts of the Network (such as equipment, cables and/or fixtures) may be located on our premises. We are merely providing you access to the Network using the Hotspot Device.

18.2 From time to time and in order to protect and enhance the Network, the network service provider will need to take appropriate actions to protect, maintain, improve and/or manage the Network. You may not be able to access the Network during such period. Where we can, we will give you reasonable advance notice.

18.3 We shall not be liable for any loss you may incur or suffer during the period the Network access is down or inaccessible.

18.4 You will not undertake or permit anyone to undertake any Unauthorised Acts and will notify us as soon as you are aware of any Unauthorised Acts.

19. Links
19.1 You may provide links to the Website or App, provided (a) that you do not remove or obscure, by framing or otherwise, any portion of our website or mobile application, (b) your website does not engage in illegal or immoral activities, and (c) you discontinue providing links to the Website immediately upon request by us.

19.2 The App may contain links to third party websites (“Third Party Websites”). These links are provided solely as a convenience to you. By linking to these Third Party Websites, we do not create or have an affiliation with, or sponsor such Third Party Websites. The inclusion of links within the App does not constitute any endorsement, guarantee, warranty, or recommendation of such Third Party Websites. DataPro has no control over the legal documents and privacy practices of Third Party Websites; as such, you access any such Third Party Websites at your own risk.

20. Intellectual Property 
20.1 All intellectual property rights subsisting in respect of the Website, App the Kiosk and the Hotspot Device belong to DataPro or have been licensed to DataPro. The Website, App, the Kiosk, the Hotspot Device and the Hotspot Services and Other Services are protected by international copyright and other intellectual property rights as collective works and/or compilations, pursuant to applicable copyright laws, international conventions, and other intellectual property laws. You undertake that: (a) You shall not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, distribute, perform, display, or in any way exploit, any part of the Website, App, the Kiosk, the Hotspot Device and the Hotspot Service and the Other Services, software and materials in whole or in part.

20.2 The Website, App, the Hotspot Device and the Kiosk may contain our trademarks as well as those of our partners and affiliates and third party services providers, in the form of words, graphics, and logos. Your use of the Website, App, the Kiosk, the Hotspot Device, the Hotspot Service and Other Services does not constitute any right or license for you to use such trademark, without the prior written permission of the corresponding trademark owner.

21. Indemnity
21.1 You will indemnify and hold DataPro and our holding companies, subsidiaries, partners and affiliates and third party service providers and our/their officers, directors and employees harmless from, including but not limited to all damages, liabilities, settlements, costs and attorney’s fees, claims or demands made by any third party due to or arising out of your access and use of the Hotspot Services and Other Services or your violation of this Terms of Use.

22. Disclaimers
22.1 DataPro has no special relationship with or fiduciary duty to you for accessing and using Hotspot Service and/or the Other Services. You acknowledge that DataPro and our partners and affiliates and third party service providers has no control over, and no duty to take any action regarding the access and use of the Hotspot Service and Other Services.

22.2 You acknowledge and agree that our partners and affiliates and third party service providers may offer services other than the Other Services on the Website, App or the Kiosk. DataPro makes no representations or warranties regarding the accuracy of descriptions anywhere on the services offered.

22.3 In no event will DataPro, or any of DataPro’s holding companies, subsidiaries, affiliates, partners and third party service providers and our/their, officers, directors and/or employees be liable for any loss of profits or any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from: (a) access or use Hotspot Service or the Other Services or (b) This Terms of Use; or (c) Any breach of this Terms of Use by you or a third party, even if we have been advised of the possibility of such damages.

22.4 These limitations and exclusions apply without regard to whether the damages arise from: (a) Breach of contract; or (b) Breach of warranty; or (c) Strict liability; or (d) Tort; or (e) Negligence; or (f) Any other cause of action, to the maximum extent that such exclusion and limitations are not prohibited by applicable law.

23. Warranty Disclaimer
23.1 THE WEBSITE, APP, KIOSK, THE HOTSPOT DEVICE, THE HOTSPOT SERVICE AND THE OTHER SERVICES ARE PROVIDED “AS-IS,” “AS AVAILABLE,” WITH “ALL FAULTS”, AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE WEBSITE, APP AND HOTSPOT DEVICE MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. DATAPRO, INCLUDING ALL OUR PARTNERS, AFFILIATES AND THIRD PARTY SERVICE PROVIDERS, HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF THE WEBSITE, KIOSK, THE HOTSPOT DEVICE, THE HOTSPOT SERVICE AND THE OTHER SERVICES, OTHER THAN AS SPECIFIED IN OUR LEGAL TERMS. DATAPRO CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF THE WEBSITE, APP, KIOSK, THE HOTSPOT DEVICE, THE HOTSPOT SERVICE AND OTHER SERVICES. DATAPRO DOES NOT REPRESENT OR WARRANT THAT THE WEBSITE, APP, KIOSK AND HOTSPOT DEVICE ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR THAT IT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THEREFORE, YOU SHOULD EXERCISE CAUTION IN THE USE OF THE WEBSITE, APP AND HOTSPOT DEVICE AND USE INDUSTRY-RECOGNIZED PROGRAMMES TO DETECT AND REMOVE VIRUSES. ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY VIRUSES SOMEHOW ATTRIBUTED TO THE WEBSITE, APP OR HOTSPOT DEVICE IS DISCLAIMED. WITHOUT LIMITING THE FOREGOING, YOU UNDERSTAND AND AGREE THAT YOU USE OUR WEBSITE, APP AND HOTSPOT DEVICE AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR YOUR USE THEREOF AND ANY DAMAGES TO YOU, YOUR MOBILE DEVICE OR COMPUTER SYSTEM, OR OTHER HARM OF ANY KIND THAT MAY RESULT. WE, AS WELL AS ALL OF OUR PARTNERS, AFFILIATES AND THIRD PARTY SERVICE PROVIDER ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF INCOME, BUSINESS, PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE NEGATION AND LIMITATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND DATAPRO. THE HOTSPOT SERVICE AND THE OTHER SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US THROUGH THE WEBSITE OR KIOSK SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN OUR LEGAL TERMS.

23.2 To the fullest extent permissible by applicable law, DataPro makes no representations or warranties of any kind, either expressed or implied, including but not limited to the telecommunication or data connectivity using the Hotspot Device or for any breach of security associated with the transmission of information (sensitive or otherwise) using the Hotspot Service or Hotspot Device or that the use of the Hotspot Service or Hotspot Device will be uninterrupted or error-free.

23.3 You acknowledge and agree that any transmission using the Hotspot Device and Hotspot Service is not confidential and your communications may be read or intercepted by others. You further acknowledge and agree that by submitting information and communications on the Website and the Kiosk, including passport and boarding pass details, no confidential, fiduciary, contractually implied or other relationship is created between you and DataPro other than pursuant to this Terms of Use.

23.4 You acknowledge and agree that you will not hold or seek to hold DataPro responsible for the content provided by any of our partners and affiliates and third party service providers and you further acknowledge and agree that DataPro is not a party to any transaction in relation to the Other Services provided by any of our partners and affiliates and our third party service providers. DataPro has no control over and does not guarantee the safety of any transaction and/or activities or the truth or accuracy of any listings or other content provided by any of our partners and affiliates and our third party service providers.

23.5 Access to the Hotspot Service and/or Other Services may be temporarily unavailable from time to time for maintenance or other reasons. DataPro assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, the Hotspot Service or Other Services. DataPro is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers, computer or mobile phone equipment, website on account of technical problems or traffic congestion on the Internet or any combination thereof, including injury or damage to anyone’s computer, mobile phone, or other hardware or website, related to or resulting from using the Hotspot Device, the Hotspot Service and/or Other Services,. Under no circumstances will DataPro be responsible for any loss or damage, including any loss or damage or personal injury or death, resulting from anyone’s use of the Hotspot Device, the Hotspot Service and/or Other Services, or for any interactions between you and our representatives, whether online or offline.

24. Remedies
24.1 If you are dissatisfied with the Hotspot Service or the Other Services, do not agree with any part of this Terms of Use, or have any other dispute or claim with or against DataPro or any of our partners and affiliates and third party services providers with respect to the Hotspot Service and Other Services, your sole and exclusive remedy against DataPro is to discontinue use of the Hotspot Service or the Other Services.

24.2 DataPro, as well as all our affiliates, shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from (a) any errors in or omissions from the ,Hotspot Device, Hotspot Service or the Other Services; (b) the unavailability or interruption of the Hotspot Service or the Other Services; (c) your use of the Hotspot Device Hotspot Service or the Other Services; or (d) any delay or failure in performance of the Hotspot Service or the Other Services.

24.3 DATAPRO AND ITS PARTNERS, AFFILIATES AND THIRD PARTY SERVICES PROVIDER ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM. DATAPRO AND ITS PARTNERS, AFFILIATES AND THIRD PARTY SERVICE PROVIDER HAVE NO LIABILITY AND WILL MAKE NO WARRANTY, REFUND, OR OTHER RESTITUTION TO YOU WITH REGARDS TO THE HOTSPOT DEVICE, HOTSPOT SERVICE AND OTHER SERVICES, OTHER THAN AS SPECIFIED HEREIN, FOR ANY REASON, INCLUDING, BUT NOT LIMITED TO, DELAYS, CANCELLATIONS, STRIKES, GOVERNMENTAL ISSUES, OR FORCE MAJEURE.

24.4 IN NO EVENT WILL DATAPRO OR ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOSSES ARISING FROM YOUR USE OF THE HOTSPOT DEVICE, HOTSPOT SERVICE AND OTHER SERVICES, EVEN IF DATAPRO IS AWARE OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, DATAPRO’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO YOUR CEASING USE OF THE HOTSPOT DEVICE, HOTSPOT SERVICE AND OTHER SERVICES.

24.5 Any cause of action by you with respect to the Hotspot Service and the Other Services, must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of our Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. The rights of DataPro under our Legal Terms shall survive the termination of our Legal Terms.

25. Governing Law
25.1 This Terms of Use shall be governed by the laws of the Republic of Singapore. You agree to submit to the non-exclusive jurisdiction of the courts of the Republic of Singapore.

26. Miscellaneous
26.1 If any provision of this Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Terms of Use shall otherwise remain in full force and effect and enforceable.

26.2 This Terms of Use is not assignable, transferable or sub-licensable by you except with DataPro’s prior written consent. DataPro may transfer, assign or delegate this Terms of Use and its rights and obligations without prior notice to you.

26.3 This Terms of Use have been drafted, and shall be construed, in the English language. Any translation of the Terms of Use is solely for reference only. In the event of inconsistency between the English language version and a translated version, the English language version of the Terms of Use shall always prevail.

26.4 We will not be liable for any delay or failure in performance under this Agreement resulting from matters beyond our reasonable control. These include acts of God, requirements of any governmental or regulatory authority, war, national emergency, acts of terrorism, accident, fire, lightning, equipment failure, cyberattacks (including any type of offensive manoeuvre that targets computer information systems, infrastructure, computer networks or personal computer devices), computer software or software malfunction (including due to malicious software programmes), interception of online communication, identity theft, electrical power failure, faults, interruption or disruption of the Network or the networks of the Service Providers or of your equipment or the equipment of any third party, riots, strikes, lock-outs, industrial disputes (whether or not involving our employees) or epidemics of infectious diseases.

28. Required Assistance
28.1 If you attempt to use the Hotspot Device in accordance with this Terms of Use and you are unable to do so (due to our fault or of our partners and affiliates and our third party service providers or otherwise), please contact DataPro at support@hotspot.travel and DataPro will try to remedy the fault.
